Jewish law has a history stretching from the early period to the modern State of Israel, encompassing the Talmud, Geonic and later codifications, the Spanish Golden Age, medieval and modern responsa, the Holocaust and modern reforms. Fifteen distinct periods are separately studied in this volume, each one by a leading specialist, and the emphasis throughout is on the development of the institutions and sources of the law.

In this essay Mordechai Gordon begins to address the neglect of humor among philosophers of education by focusing on some interesting connections between humor, self‐transcendence, and the development of moral virtues. More specifically, he explores the kind of humor that makes fun of oneself and how it can affect educational encounters. Gordon begins his analysis by discussing the nature and purpose of humor in general, while distinguishing it from laughter and amusement. In the next part of the essay, he (...) takes a close look at the characteristics and benefits of the type of humor that we use when we make fun of ourselves. He then turns his attention to exploring the relation between laughing at ourselves, self‐transcendence, and a number of moral virtues. The Calvinist view that man is predestined to be among the elect or the damned has profoundly influenced not only our views of criminals and deviants, but also the theoretical basis of correctional methods and psychotherapeutic techniques. In this provocative and original volume, Mordechai Rotenberg examines the impact of Protestant doctrine on Western theories of deviance. Objetiva apresentar a proposição de mediação da informação “em presença” numa dimensão cosmopolítica. Para tanto, aborda contextos de mediação da informação e suas implicações para pesquisa, formação e atuação profissional no campo da ciência da informação e apresenta o alcance das associações entre atores humanos e não-humanos, evidenciando a agência de implicadores e implicados. Situa docente-pesquisador e profissional de informação como implicadores, e usuário e não-usuário de informação como implicados, em modos de mediação tradicional ou contemporâneo. Problematiza essa composição inicial (...) ao dialogar com princípios de situacionalidade, de transitoriedade e de simetria dos atores. Com isso, delineou-se quatro situações: 1. Docente-pesquisador e profissional da informação podem implicar a dimensão cultural dos usuários e dos não-usuários; 2. Usuário de informação como implicador e profissional de informação como implicado; 3. Docente-pesquisador como implicado no ensino e na pesquisa sobre mediação da informação; e 4. Docente-pesquisador e profissional de informação implicam em e são implicados por atores não-humanos. Depreendeu-se que “estar em presença” em contextos mediacionais se torna um ponto de contato entre cosmologias. Mordechai Rotenberg, who is well known for his work on the pessimistic impact of Protestant ethics on the Western social sciences, presents here a systematic study derived from, and based on, Judeo-Hasidic ethics. Proceeding from the cabalistic-Hasidic concept of contraction (tzimtsum), according to which God's voluntary withdrawal into Himself to evacuate space for the world serves as a model for human behavior, Professor Rotenberg shows that it is not personal-social construction, but self- and social contraction, that explains how the (...) Proportionality in Action presents an empirical and comparative exploration of the proportionality doctrine, based on detailed accounts of the application of the framework by apex courts in six jurisdictions: Germany, Canada, South Africa, Israel, Poland and India. The analysis of each country is written and contextualized by a constitutional scholar from the relevant jurisdiction. Each country analysis draws upon a large sample of case law and employs a mixed methodological approach: an expansive coding scheme allows for quantitative analysis providing comparable (...) and quantifiable measurements, which is enriched by qualitative analysis that engages with the substance of the decisions and captures nuance, contextualizing the data and providing it with meaning. The book concludes with a comparative chapter that synthesizes some of the most interesting findings. The article explores the Israeli Supreme Court main judgment regarding the legality of the use of special interrogation methods in order extract information concerning future acts of terror. The Judgment's main conclusion was that while there might be a justification for using exceptional interrogation measures in order to save lives, based on the concept of lesser evil as embedded in the criminal defense of necessity, the government is nevertheless not authorized to use such means in the absence of explicit legislation (...) to that effect. The article presents and evaluates the Judgment, particularly the relation between the substantive moral questions involved and the aspect of authorization. (shrink)

In this essay, Mordechai Gordon explores the significance of Rilke’s challenge to “live the questions” and embrace uncertainty with respect to the quest for certainty in education. The quest for certainty in education refers to our desire to gain a sense of psychological security and more control over a field that is fundamentally indeterminate. This quest implies an unwillingness to live with the inherent complexities and risks of education. After exploring the meaning and import of Rilke’s challenge and comparing (...) it to the position of Socrates, Gordon uses Rilke’s insight to analyze a specific educational experience and then discusses some of its educational implications for teacher education. Philosophers of perception frequently assume that we see actual states of affairs, or facts. Call this claim factualism. In his book, William Fish suggests that factualism is supported by phenomenological observation as well as by experimental studies on multiple object tracking and dynamic feature-object integration. In this paper, I examine the alleged evidence for factualism, focusing mainly on object detection and tracking. I argue that there is no scientific evidence for factualism. This conclusion has implications for studies on the phenomenology (...) and epistemology of visual perception. (shrink)

The sensorimotor theory of vision and visual consciousness is often described as a radical alternative to the computational and connectionist orthodoxy in the study of visual perception. However, it is far from clear whether the theory represents a significant departure from orthodox approaches or whether it is an enrichment of it. In this study, I tackle this issue by focusing on the explanatory structure of the sensorimotor theory. I argue that the standard formulation of the theory subscribes to the same (...) theses of the dynamical hypothesis and that it affords covering-law explanations. This however exposes the theory to the mere description worry and generates a puzzle about the role of representations. I then argue that the sensorimotor theory is compatible with a mechanistic framework, and show how this can overcome the mere description worry and solve the problem of the explanatory role of representations. By doing so, it will be shown that the theory should be understood as an enrichment of the orthodoxy, rather than an alternative. (shrink)

Tolerance is possible either through an ideological balance of terror between equal opposing powers or through mutual volitionary space evacuating Cabalic style contraction. According to the Biblical definition of covenant, brit, a coexisting shalom (peace) is possible only through separating and rebinding which comprises the shalem (complete). Japanese (...) Makuya Christianity is presented as an anti‐imperialistic model for mutual contraction facilitating the coexisting shalom‐shalem between equals who are different but not indifferent to each other. LA JUVENTUD CONSUMIDA: REPRESENTACIONES DE LO JUVENIL EN EL DISCURSO PUBLICITARIO.

The Critique of Pure Reason—Kant’s First Critique—is one of the most studied texts in intellectual history, but as Alfredo Ferrarin points out in this radically original book, most of that study has focused only on very select parts. Likewise, Kant’s oeuvre as a whole has been compartmentalized, the three Critiques held in rigid isolation from one another. Working against the standard reading of Kant that such compartmentalization has produced, The Powers of Pure Reason explores forgotten parts of the First (...) Critique in order to find an exciting, new, and ultimately central set of concerns by which to read all of Kant’s works. Ferrarin blows the dust off of two egregiously overlooked sections of the First Critique—the Transcendental Dialectic and the Doctrine of Method. There he discovers what he argues is the Critique’s greatest achievement: a conception of the unity of reason and an exploration of the powers it has to reach beyond itself and legislate over the world. With this in mind, Ferrarin dismantles the common vision of Kant as a philosopher writing separately on epistemology, ethics, and aesthetics and natural teleology, showing that the three Critiques are united by this underlying theme: the autonomy and teleology of reason, its power and ends.
